These are the terms and conditions for guests to read and agree to when staying anywhere at Kinton Escapes.
Reading, understanding and accepting these terms is a condition of your booking, either through www.canopyandstars.co.uk or from our own website, www.kintonescapes.co.uk or by any other means. A copy of these terms will be left in every space.
Booking & payments:
1.1 The dates of your booking will be held upon payment of a non-refundable deposit of 50% or payment in full. Deposits are only payable when you make your booking more than 4 weeks in advance of your check in date. Any booking made less than 4 weeks in advance of your check in date must be paid in full at the time the booking is made.
1.2 On receipt of the deposit/payment, a booking confirmation will be sent to you by email containing the details of your stay, details of payments made and details of payments still due. If you have not received your booking confirmation within 48hrs, please notify us by email as soon as possible. 1.3 Where a deposit has been paid, the full balance payment will be due 4 weeks in advance of your check in date and a reminder will be sent to you prior to this date, by email. If you are unable to pay the balance before the stated due date, you will forfeit your deposit and your booking will be automatically cancelled.
Cancellation
2.1 Cancellation by you at any time will result in your deposit being forfeited, as all deposits are non- refundable. 2.2 All monies paid for a holiday (deposit and balance) are non-refundable within 4 weeks of the check in date. 2.3 Cancellation of any holiday after it has been paid in full and at a date 4 weeks or more in advance of your check in date, will result in forfeiture of your deposit (or an amount equivalent where one was not paid as the holiday was paid in full) and the balance being returned to you. 2.4 Kinton Escapes reserve the right to cancel any booking at any point before or during a Guest’s stay for any reason (including but not limited to severe flooding, dangerous site conditions or adverse weather conditions). Provided the termination is not due to the Guest being in breach of these terms they will be refunded for all of their holiday if it is prior to their booking or any remaining nights if it is during their booking. 2.5 In extreme weather conditions at the site, such as exceptional cold and snow, we will do all we reasonably can to warn guests and give guests the option to move dates (subject to availability) without additional charge. 2.6 Kinton escapes cannot accept responsibility for any loss, damage, or expense arising from industrial action, terrorist activity, adverse weather conditions or any other event outside the control of the company. 2.7 We strongly advise visitors to take out full holiday insurance to cover cancellations, public liability, personal belongings, personal injury, loss etc. 2.8 We will always try to re-let the cancelled dates to another party and if we succeed in doing so you will be refunded your booking less the deposit and any other expenses incurred.
Alteration
3.1 Alterations to your booking can only be made more than 4 weeks prior to the check in date, after which time alterations will be treated as a cancellation. All alterations are subject to availability. 3.2 Differences in the total amount payable resulting from alterations will be refunded to you in the case of a decrease in price and paid by you in the case of increases in price.
Complaints
In the event that you have any complaint about your stay, please notify Frankie Duckworth as soon as possible and we will use all reasonable endeavours to resolve the issue. This maybe done in person, or by text or email.
Pricing
Prices on the website are not binding, but costs stated in any booking confirmation email you receive from Kinton escapes will be honoured as shown. We may choose to change pricing for any reason, to promote an offer or because of higher demand, so it may be that what you have paid does not reflect the current price of that space when you stay.
Information
Information on the website is correct to the best of our knowledge, but circumstances outside of our control may cause it to become inaccurate. We apologise for any inconvenience that may result from this. You will be sent a full information pack upon booking which will include these Terms & Conditions.
Arriving and Departing
7.1 Kinton Escapes is a small private site so there is no reception. Usually Frankie will be available for checking in an out. Please tell us your estimated arrival time the evening before your stay by text or email, and if your ETA changes due to heavy traffic etc. please send us an updated ETA, so that where possible we can arrange to have someone here to meet you when you arrive. 7.2 Check in is from 4pm onwards, and we ask that guests vacate by 10am on the morning of their departure. Other times are possible by arrangement.
Pets
8.1 We sadly cannot accept pets due to concerns of livestock and hygiene.
Conduct on site
9.1 Kinton Escapes is based on a working estate that carries the usual dangers such as livestock, tractors, machinery etc. Areas of farm buildings adjacent to the drive are out of bounds to guests.
9.2 Guests and visitors agree to be considerate tenants and to take good care of all facilities during their stay. Guests and visitors agree not to act in any way which would cause disturbance to other guests or be inappropriate for guests staying in other spaces.
9.3 If there are any complaints about your behaviour you will be given one warning. If you continue then you will be asked to leave the site immediately. Thankfully this has never happened as yet.
9.4 Should any facilities, equipment, or items, be damaged wilfully, as a result of inappropriate usage or behaviour, as a direct result of failing to respond to instructions showing how to use the equipment or due to your negligence you will be held responsible for the cost of repair or replacement of that item.
9.5 By Booking and coming to Kinton Escapes you agree to be responsible for your own welfare and to take all reasonable precautions against personal injury, injury to others and damage to the facilities.
9.6 Camping in Britain can mean dramatic variance in weather in a short period of time. Whilst we supply certain facilities and equipment, as described on our website, it is still camping and you are responsible for your own well-being and comfort regarding appropriate clothing and appropriate footwear etc. It is better to bring extra layers and not use them than to be cold and miserable!
9.7 Fires on site are only permitted within the wood burning stoves, barbeque Chimineas and fire- pits as supplied or authorised by Kinton Escapes.
Liability
10.1 Kinton Escapes accepts no liability for accident, loss of property or personal injury incurred during stay with us. 10.2 Use of woodland, chiminea, fire-pit, wood-burning stoves, the climbing of trees, using the hammocks, contact with farm animals and any other activity at Kinton escapes is the responsibility of the Guest and is done so at their own risk.
10.3 By making a booking, you confirm you acknowledge these Terms and Conditions and that you are aware of the risks, hazards, and dangers of personal injury by entering onto Kinton escapes and into the surrounding woodland and farmland, and agree to behave in a sensible manner to avoid injury. 10.4 We have taken every precaution to avoid any incident occurring on the estate, but accidents can sometime not be avoided. You will have understood and agreed that Kinton escapes will not accept any liability for any accident or personal injury to Guests or any property belonging to guests.
10.5 Upon booking an ‘Information document’ is emailed to you in PDF format, that outlines how everything works. If you can’t read it please let us know and we’ll try to send it again in a format that you can read.
Privacy
11.1 Guest’s contact and personal details may be kept by us for future mailings of news and offers. If you do not wish to receive these, please let us know by sending us an email. You may also opt out of receiving emails at any time by contacting us by email, and we will take you off our mailing list.
11.2 The booking process asks for your address details and phone numbers. These are required by the Local Authority so at any time we can prove you are not residents at Kinton. It also allows us to contact you should the internet fail and if we need to contact you whilst you are travelling to Kinton. Please note that your financial details are NEVER stored, or seen, by us. Your personal details are never sold or shown to anyone else.
Breach of Terms and Conditions
12.1 If there is a breach of any of these conditions by the Guest or any of their party, Kinton Escapes reserves the right to terminate your stay and ask you and the rest of your party to leave, without prejudice to any other rights specified in these Terms and Conditions.
12.2 Termination of your holiday by Kinton Escapes or you does not affect your statutory rights.
Governing Law and Jurisdiction
Any dispute will be governed by the non-exclusive law and jurisdiction of the English Courts.
Authority to Sign
The person who signs the Booking Form certifies that: he or she is authorised to agree the Booking Conditions on behalf of all persons included in the Booking Form, including those substituted or added at a later date; the signatory is over eighteen years of age; they agree to take responsibility for the party, and to notify Kinton escapes if they are not a member of the holiday party, and supply all the details of those guest actually staying at Kinton escapes.
Validity clause
In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
